General Terms and Conditions govern the use of the mercilingerie.com website (hereinafter ‘the website’) owned by MERCI LINGERIE Ltd. MERCI LINGERIE Ltd is a public limited liability company with registered business address: Poland, Wroclaw, March. Józef Piłsudski street, 74/320, zip code 50-020, KRS 0000993949, NIP: 8971912340, REGON: 523211901. By using the services offered by the MERCI LINGERIE online store, users are consenting to be bound by the General Terms and Conditions corresponding to the version published by MERCI LINGERIE when the purchase order is placed. It is therefore advisable for customers to read these General Terms and Conditions before making a purchase.
1. SCOPE OF THE AGREEMENT
General Terms and Conditions will always be subject to the regulations in force at any given time so that if any term or condition is modified by the applicable regulations (whether that modification is temporary or permanent), the client will have the rights recognized by applicable regulations and MERCI LINGERIE will inform you of any other additional measure that may be taken in your favour.
In case of contradiction between the provisions of the applicable regulations and the provisions of these General Terms and Conditions, the provisions of the applicable regulations shall apply.
General Terms and Conditions are applicable to the online sale of all MERCI LINGERIE products to consumers. MERCI LINGERIE Ltd hereby informs you that its website is for people aged 18 and over only. MERCI LINGERIE Ltd reserves the right to cancel a user’s access account if it detects fraudulent, speculative acts or acts in bad faith in the use of this service.
MERCI LINGERIE Ltd will send you an email to confirm receipt of your order. However, the purchase contract will not be formalised until MERCI LINGERIE Ltd sends a subsequent email confirming that the items ordered have been dispatched.
2. PRICE
Prices charged are those indicated on the website on the date of ordering, excluding any manifest errors. The pricing quoted on the site includes VAT (where applicable) at the rate in the delivery country on the day on which you place your order on the site. The prices quoted exclude shipping charges. The final price of your order will be communicated to you in your order summary before placing your order. MERCI LINGERIE Ltd reserves the right to make any changes it considers necessary at any time; it may update, including on a daily basis, products and prices in accordance with new items that are included on the website.
3. DELIVERY AND PAYMENT
We’re pleased to offer free shipping for all orders.
The order concidered to be delivered when the Post Office / DHL provides information that the package has been delivered.
Please note that if the customer entered the address incorrectly, we can only change it until the parcel has been shipped. If the package arrives at the wrong address specified by the customer, we are not responsible for this and cannot refund the cost of the order.
Order Processing Time:
Please be aware that we are a small producer, crafting each product with special attention to quality and detail. Our production capabilities are limited compared to large-scale manufacturers, ensuring a unique touch in every piece.
With this in mind, please allow up to 5 business days for order processing. This does not include the payment day and weekends. In rare cases, we might require additional time for processing. We reserve the right to extend this period due to factors like a high volume of orders, supply chain disruptions, or other unexpected events. If you require a more specific estimate, we encourage you to reach out to us directly.
To stay updated on the status of your order, you can conveniently track it using the tracking information provided in your shipment notification email. Please note, this tracking feature is applicable only once your order has been shipped.
Taxes and Custom Duties
Please be aware that the prices displayed on our website include VAT (where applicable) based on the rate in the destination country on the day of your order.
Shipping charges are not included in the listed prices. The final price of your order will be shown in the order summary before you complete your purchase.
As we are sending the goods from the EU, it is important to note that any additional taxes or customs duties required by law in your country are the customer’s responsibility and must be paid by the customer. These extra charges are not included in the prices of the products you are purchasing from us.
For the non EU-countries we recommend familiarizing yourself with your country’s tax laws before placing an order to understand any charges and customs duties that may be applied by your local customs office.

4. EXCHANGE AND RETURN
At Merci Lingerie, we want you to truly experience our beautiful lingerie and discover the perfect fit. We understand that purchasing online can sometimes be a bit tricky, which is why we offer free exchanges and returns to ensure you feel confident in your purchase.
We are dedicated to providing you with high-quality products that meet your expectations. If you’re not completely satisfied with your purchase, you can exchange or return it within 14 days of delivery. Please be aware that we cannot accept returns for stockings or panty products unless they are defective. Please note that you may claim that an item is defective within 48 hours after receiving the item. Otherwise, defective items will not be accepted.
Please ensure that returned or exchanged products are in their original condition: unworn, unwashed, with all tags and liners attached. We kindly ask you to wear underwear when trying on your purchase for the first time. If the returned item shows signs of wear or doesn’t meet these criteria, we reserve the right to refuse the return.
Exchange Policy
If you’d like to exchange your purchase for a different size, we’re more than happy to help. Contact us via email at info@mercilingerie.com and provide your order number, so we can provide a return label for the European Union.
Please note that for some regions in the European Union we are unable to provide a return label, but we’ll cover the cost of sending if the receipt is provided. We’ll also take care of the reshipment costs, but original outbound shipping fees from the order will not be refunded.
Exchange costs associated with shipping outside the European Union are covered by the customer, original outbound shipping fees from the order will not be refunded. Exchange parcel is sent at our expense.
Return Policy
To initiate a return, simply contact us by email at info@mercilingerie.com and provide your order number. We’ll guide you through the next steps and provide a return label for the European Union.
Please note that for some regions in the European Union we are unable to provide a return label, but we’ll cover the cost of sending if the receipt is provided. Original outbound shipping fees from the order will not be refunded.
Return costs associated with shipping outside the European Union are covered by the customer, original outbound shipping fees from the order will not be refunded.
Refunds
Once we receive your return and inspect the product, we will notify you of its acceptance or decline. This process can take up to 7 business days from the date we received your returned product. If your return is accepted, your refund will be processed and applied to the original method of payment. Please note that it may take up to 30 days for the refund to appear on your bank account due to varying processing times of financial institutions.
5. PRODUCT AVAILABILITY
If there are any issues with supply or products have gone out of stock, customers will be informed immediately and a refund will be processed for the amount pertaining to the missing items. In the event of a customer noticing certain items have not been delivered, who has not been previously informed of the situation, the customer should contact Customer Services who will make the necessary checks. MERCI LINGERIE Ltd will refund the corresponding amount without undue delay and, in all cases, this will be done within 14 working days. The refund will be made via the same payment method as used for payment. If your return is accepted, your refund will be processed and applied to the original method of payment.

The Customer Service of MERCI LINGERIE Ltd will respond to your claim as soon as possible, and within a maximum period of 14 days.
7. MODIFICATION OF THE GENERAL TERMS AND CONDITIONS
MERCI LINGERIE Ltd reserves the right to modify these General Terms and Conditions at any time with a justified cause. No modification will affect the orders that are already in progress.
8. FORCE MAJEURE
MERCI LINGERIE Ltd compliance with all or part of its obligations will be suspended in the event of an act of God or force majeure that prevents or delays compliance. They will be considered as such, in particular, without this list being limiting: war, an epidemic, riots, insurrection, social unrest, strikes of any nature and supply problems not attributable to MERCI LINGERIE Ltd. MERCI LINGERIE Ltd will inform the client of such a fortuitous event or force majeure within seven days after its occurrence. In the event that said suspension extends beyond a period of fifteen days, the client will then have the possibility of cancel the current order and MERCI LINGERIE Ltd will then proceed to reimburse the relevant amount under the conditions set forth in point 5 of these General Terms and Conditions or in those others that the applicable regulations could, where appropriate, establish.
9. APPLICABLE LAW AND JURISDICTION
These General Terms and Conditions are subject to Polish Law. In the event of any matter or dispute arising out of or in connection with these General Terms and Conditions, the parties shall submit to the exclusive jurisdiction of the Courts and Tribunals corresponding to the user’s address.
